5. Disclaimer and limitation of liability
The content of the Website, including articles, analyses, threat descriptions and regulatory references, is general and informational in nature. It does not constitute professional, technical or legal advice for any particular situation and is not a substitute for a specific assessment of your organization's circumstances. We are not liable for decisions you make based solely on that content.
We strive to keep the information on the Website accurate and up to date, but we do not warrant that it is accurate, complete or current at all times, particularly regarding laws and regulations, which may change after publication. We may modify, update or remove content without notice.
We take reasonable measures to keep the Website operating correctly and securely, but the Website is provided "as is" and "as available". To the fullest extent permitted by law, we do not warrant uninterrupted availability or that the Website will be free of errors or harmful components, and we shall not be liable for any loss or damage arising from interruptions, technical failures, attacks or causes beyond our reasonable control, or from use of the Website in breach of these Terms.
Nothing in these Terms excludes or limits our liability where such exclusion or limitation is not permitted by law, such as in cases of fraud, willful misconduct or gross negligence, nor does it affect any rights you have under mandatory law.
6. Links
The Website may include links to third-party websites, such as professional social network profiles, public bodies or reference publications. These links are provided for information only. We do not control those websites and are not responsible for their content, availability or privacy practices, and the inclusion of a link does not imply endorsement of, or any relationship with, their owners. 7. Marketing communications
In accordance with Articles 20 and 21 LSSI-CE and, where applicable, the U.S. CAN-SPAM Act, we will not send marketing communications by email or equivalent electronic means unless the recipient has requested or expressly authorized them, or unless there is an existing contractual relationship and the communications concern services similar to those already contracted. All marketing communications will be clearly identified as such, will state that they come from ZERYON (INFOSEC TECHNOLOGIES ESP LLC) and will include a simple, free way to opt out. You can also unsubscribe at any time by writing to [email protected].
8. Privacy and cookies
The processing of users' personal data is governed by our Privacy Policy, and the use of local storage and, where applicable, cookies is governed by our Cookie Policy, both of which can be accessed from the footer of the Website.
9. Responsible disclosure
Security is at the heart of ZERYON. If you believe you have found a security vulnerability on the Website or in any other system operated by INFOSEC TECHNOLOGIES ESP LLC, please report it to us confidentially at [email protected], including a description of the issue, the steps needed to reproduce it and its potential impact.
For research to be considered in good faith, we ask that you:
- Do not access, modify, delete or exfiltrate third-party data beyond what is strictly necessary to demonstrate the vulnerability, and tell us if you accidentally access any personal data.
- Do not carry out denial-of-service attacks, social engineering, physical attacks or any testing that could degrade the service or affect other users.
- Do not exploit the vulnerability beyond verifying it, and do not disclose it publicly until we have had a reasonable period to fix it, which, unless otherwise agreed, will be ninety (90) days from your report.
- Comply with all applicable laws.
For our part, we will aim to acknowledge your report within five (5) business days, keep you informed of our progress and, if you wish, publicly credit your contribution. We will not pursue legal action against anyone who acts in good faith and in accordance with these guidelines. This is not a bug bounty program and does not entitle reporters to any payment. Reporters' personal data is processed in accordance with our Privacy Policy.
If you are a ZERYON client and need to report a security incident affecting your organization, please use the contact channels set out in your services agreement.
10. Changes
We may amend these Terms, as well as the configuration, presentation and content of the Website, at any time. Changes take effect when published on the Website, together with the date of the last update. We recommend that you review these Terms periodically.
11. Severability
If any provision of these Terms is held to be invalid or unenforceable, in whole or in part, the remaining provisions will remain in full force and effect, and the affected provision will be replaced by a valid one that comes as close as possible to its original purpose.
12. Governing law and jurisdiction
These Terms and the use of the Website are governed by the laws of the State of New Mexico, U.S.A., and, where applicable, the federal laws of the United States of America, without regard to conflict-of-laws principles.
This is without prejudice to any mandatory rules that apply by reason of the user's place of residence, in particular data protection laws (GDPR and LOPDGDD), information society services laws (LSSI-CE) and, where the user is a consumer, the consumer protection laws of the EU Member State in which they reside, the protection of which cannot be removed by a choice of law.
Any dispute relating to the Website shall be submitted to the competent courts of the State of New Mexico, unless mandatory law confers jurisdiction on other courts. In particular, users who are consumers resident in the European Union may bring proceedings before the courts of their place of residence. Relationships arising from the provision of services will be governed by the law and jurisdiction set out in the relevant contract.
Before bringing any legal proceedings, we invite you to contact us at [email protected] so that we can try to resolve the matter amicably.
13. Language
These Terms are available in English and Spanish. Both versions are equally valid. In the event of any discrepancy between them, and to the extent permitted by applicable law, the version in the language in which the user viewed the Website shall prevail.
